Terms

Project terms

Effective date: November 1, 2026

This page summarizes how we work. Every client signs our Client Services Agreement with their first scope, and care-plan clients also sign our Care Plan Addendum. If anything here differs from your signed agreement or your written scope, the signed documents apply.

Quotes and scope

Every project is confirmed in a written scope listing deliverables, formats, quantities, revision rounds, timing and price. Work outside that scope is quoted separately before it starts. Quotes are valid for 30 days from the date we send them. After that, we'll confirm the price again before work starts. Timelines are good-faith estimates, not guaranteed dates.

Payment

Payments are taken through a hosted invoice or payment link from our payment provider (Stripe). We never ask for card details by email or on this website. Your scope says which schedule applies: website packages and custom projects are usually a 50% deposit to start and 50% when the work is finished, before final files are delivered or the site is launched; small fixed packages, such as the Starter product video, are paid in full upfront. If a payment is more than 15 days overdue, we may pause work until it's paid.

Care plans

  • Care plans are billed monthly in advance through Stripe and renew automatically each month until you cancel.
  • On Business and Business Pro care, text, email, phone-number and AI usage is billed at cost on top of the monthly fee, as small automatic top-ups.
  • You can cancel any time, online through the link in your Stripe receipts or by emailing heliasdigitalstudio@gmail.com. Cancellation takes effect at the end of the month you've already paid for. Months already billed aren't refunded. There's no long-term contract.
  • We give at least 30 days' notice by email before changing a plan's price.

What you provide

You supply the photos, footage, logos, text and other materials listed in the scope, and confirm you own them or have permission to use and edit them for the agreed purpose. For property photos, that includes a photographer's licence that allows editing and AI processing. Turnaround starts when we have everything listed.

We review source files before confirming a fixed price. If files turn out to be unsuitable after work begins (for example, too low-resolution), we'll propose new files, a reduced scope or an adjusted price. If none works for you, either of us can end the project under the cancellation terms below.

Revisions, approval and fixes

Unless your scope says otherwise, two rounds of revisions are included (one for the Starter product video). You're responsible for checking logos, label text, product colors, garment details, prices, claims and, for property work, visual accuracy before approving final files. If you'd like more rounds, we'll quote them in writing before doing the work. Fixing something we got wrong against the agreed scope doesn't count as a revision.

If a deliverable doesn't match the agreed scope, tell us within 14 days of delivery or launch (or the longer fix window in your package) and we'll fix it at no extra charge. If we can't fix it, you can have a refund for that deliverable instead.

AI-assisted work

Some deliverables are made with AI-assisted tools. Your scope names the tools we expect to use, and we disclose where they're used. AI-generated motion can introduce visual inconsistencies; we review for them and you approve the final result. Stylized or concept images are not presented as unedited product or property photos. We don't use AI to depict a real person or another company's brand without written permission.

Property media

Photo-based walkthrough-style videos are presentations made from still photos — not filmed tours, 3D tours, floor plans or verified layouts. We identify every image we've digitally altered and deliver the original with it. Listing platforms, MLS rules and state law may require edited or AI-generated media to be disclosed; you are responsible for how delivered media is used and labelled in a listing.

Cancellations and refunds

  • Work starts when we email you to confirm it has begun. We never start before your first payment.
  • Before work starts: your deposit or upfront payment is refunded in full.
  • Once work has started: the deposit or upfront payment is non-refundable, because it covers the time we reserve for your project and the initial work. If you cancel after we've completed more work than you've paid for, the extra work is billed, up to the project price.
  • After final delivery: payments for delivered work are non-refundable, apart from the fix-or-refund remedy above.
  • We may end a project if a payment stays overdue, if we're asked to do something unlawful or infringing, or for any other reason with a refund for work not yet done.
  • Care plans: see above.

Nothing in these terms limits any rights you have under consumer protection law that can't be waived.

Ownership and portfolio use

Once the project is paid in full, you own the final deliverables listed in your scope, and we transfer to you whatever rights we hold in them. Until then, you may review drafts but not use them publicly.

  • We keep ownership of our own templates, code components, workflows and methods, and may reuse them. Where they're part of your deliverables, you get a permanent licence to use and modify them as part of those deliverables, which you can pass on if you sell your business or website.
  • Fonts, stock images, music and similar third-party assets stay under their own licences. We'll tell you if a licence limits how you can use something.
  • Parts of AI-generated material may not be protected by copyright, so we can't promise exclusive rights in them. We only pass on the rights the law and the tool's terms allow.

We only show your project publicly with your separate written permission.

Care plans and GoHighLevel

On Business and Business Pro care, lead follow-up runs in a GoHighLevel account that we set up and manage for you. Messages go out in your business's name, under carrier (A2P 10DLC) registration in your name. You're responsible for having your customers' consent to be texted or emailed, and for your own privacy notice to them. We set the system up with opt-out handling, quiet hours, a clearly automated AI assistant and review requests to every customer, and we may pause anything that looks non-compliant.

You own your contacts and conversation history. If you cancel, we'll export them, hand over your website files, and help move your business phone number to another provider. The automations themselves stay with the studio's account.

Business Pro websites require Business Pro care, starting when the site launches, because their booking, CRM and automated follow-up run on it. If you cancel, the website stays yours, but booking and automations stop at the end of the paid month. You can move to Essential care to keep hosting and edits.

Liability

Our total liability to you is limited to what you paid us in the 12 months before the claim, and neither of us is liable to the other for indirect losses such as lost profits, sales or bookings, except where the law doesn't allow these limits. You're responsible for claims that arise from the materials you supply and from how you use the work.

No guaranteed results

We don't guarantee sales, bookings, rankings, ad performance, sale prices or approval by any platform.

Governing law

California law governs these terms and your agreement with us.
